1. Overview
LankaPros respects the intellectual property rights of others and expects members to do the same. Members can post to the feed, write articles, send messages, upload photos and fill in profiles. If you believe content on LankaPros infringes your copyright, you can ask us to remove it by sending a notice as described below.
2. Sending a takedown notice
Email notices to support@lankapros.com with the subject line “DMCA notice”. Under 17 U.S.C. § 512(c)(3), a notice should include:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to be infringed (or a representative list if several works are covered).
- Identification of the material claimed to be infringing, with information reasonably sufficient for us to locate it, such as the profile or post URL.
- Your contact information: name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Incomplete notices may delay our response. Knowingly misrepresenting that material is infringing may expose you to liability under 17 U.S.C. § 512(f). Members can also use the “Report profile to support” link on any profile page to flag content; for copyright claims, please include the details above.
3. What happens next
When we receive a complete notice, we will act expeditiously to remove or disable access to the material and make reasonable efforts to notify the member who posted it, including a copy of the notice.
4. Counter-notice
If your content was removed and you believe this was a mistake or misidentification, you may send a counter-notice to the same address. Under 17 U.S.C. § 512(g)(3), it should include:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which LankaPros may be found), and that you will accept service of process from the person who submitted the original notice or their agent.
We will forward a valid counter-notice to the original complainant. If they do not notify us within 10 business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the material within 10 to 14 business days after receiving the counter-notice.
5. Repeat infringers
We will terminate, in appropriate circumstances, the accounts of members who are found to be repeat infringers.
6. Designated agent
